Welcome to ZYPmed.com. This website is owned and operated by ZYP Medical, LLC. By accessing or using this site, you agree to comply with and be bound by the following Terms and Conditions of Use (“Terms”). Please review these Terms carefully. If you do not agree, do not use this site.
1. Terminology
The following terminology applies to these Terms and any related Agreements: “Client,” “Patient,” “Customer,” “You,” and “Your” refer to you, the person accessing this website and accepting the Company’s terms and conditions. “ZYP Medical,” “Company,” “Ourselves,” “We,” “Our,” and “Us” refer to ZYP Medical, LLC. “Party” or “Parties” refers to both the Client and the Company. Singular, plural, capitalization, and gendered references are interchangeable.
2. Agreement
This Terms of Use agreement (the “Agreement”) specifies the terms and conditions for access to and use of the ZYP Medical website (the “Site”). This Agreement may be modified at any time by ZYP Medical, LLC upon posting of the modified Agreement. Any such modifications are effective immediately. The most recent version is always available at www.ZYPmed.com/terms-of-use. Each use by you constitutes your unconditional acceptance of this Agreement.
3. About ZYP Medical and Our Services
ZYP Medical, LLC is a direct-pay medical practice offering telemedicine services including men’s health and testosterone replacement therapy (TRT), medical weight loss (including GLP-1 medications), and virtual urgent care. Services are provided by a licensed Family Nurse Practitioner and are delivered through secure telehealth technology to patients located in states where our provider is licensed.
3.1 States Where We Provide Care
Virtual urgent care and medical weight loss services are available to patients physically located in: Nebraska, Iowa, South Dakota, Arizona, Colorado, Kansas, and Minnesota.
Men’s health and testosterone replacement therapy (TRT) services are available to patients physically located in: Nebraska, Iowa, and Arizona (states where our provider holds an active DEA registration).
ZYP Medical cannot provide care to patients physically located in any state not listed above. Services available vary by state based on provider licensure and applicable law. The list above may be updated from time to time; the current list posted on this Site controls.
3.2 License to Use the Site
ZYP Medical grants you a limited, revocable, non-exclusive license to use this Site solely for your own personal and informational use, and for engaging ZYP Medical for telehealth services. You may not use the Site for republication, distribution, assignment, sub-license, sale, preparation of derivative works, or any other unauthorized use. You agree not to copy materials on the Site, reverse engineer or attempt to compromise the Site, or use materials, products, or services in violation of any law.
4. Medical Disclaimer and Scope of Services
The content on this Site is provided for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Accessing or browsing this Site does not create a provider-patient relationship. A provider-patient relationship is established only after a patient completes intake, is evaluated by a licensed ZYP Medical provider, and the provider accepts the patient into care.
Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency room. ZYP Medical does not provide emergency services.
4.1 Services Not Offered
ZYP Medical does not provide:
Legal representation or expert testimony for medical-legal claims;
Insurance-claim medical evaluations, independent medical examinations, or disability evaluations;
Work accommodations, workers’ compensation evaluations, or pre-surgical clearance evaluations;
Prescribing or refilling of controlled substances (Schedule II–V), including but not limited to stimulants (e.g., Adderall, Vyvanse), opioids, benzodiazepines, or Suboxone. Testosterone is a Schedule III controlled substance and is prescribed only to patients physically located in states where our provider holds an active DEA registration, in compliance with the Ryan Haight Act and applicable state law.
Evaluation or management of pregnancy-related complications.
4.2 Off-Label and Compounded Medications
Some medications prescribed by ZYP Medical providers — including compounded semaglutide, compounded tirzepatide, and certain testosterone and fertility-preservation preparations — may be used off-label or may be compounded formulations that are not FDA-approved. Compounded medications are prepared by state-licensed compounding pharmacies and are not reviewed by the FDA for safety, efficacy, or quality prior to marketing. Off-label prescribing is legal and common in medical practice when clinically appropriate.
By receiving these medications, you acknowledge that: (a) the medication is not FDA-approved for the use prescribed and/or is a compounded preparation not reviewed by the FDA; (b) risks, benefits, and alternatives have been or will be discussed with you by your provider; (c) results vary between individuals; and (d) ZYP Medical makes no guarantee of any specific clinical result, weight-loss outcome, hormonal result, fertility outcome, cosmetic outcome, or other health outcome.
5. Privacy and HIPAA
Your use of the Site is also governed by our Privacy Policy, available at www.ZYPmed.com/privacy-policy. Protected health information (PHI) you submit through ZYP Medical’s patient portal or during a telehealth encounter is governed by the Health Insurance Portability and Accountability Act (HIPAA) and our Notice of Privacy Practices. Information you submit through public-facing portions of the Site (e.g., a contact form) may not be considered PHI and should not include detailed health information.
6. Cookies and Tracking
We use first-party and third-party cookies and similar technologies. By using the Site, you consent to our use of cookies in accordance with our Privacy Policy. Some cookies are strictly necessary for the Site to function. Other cookies enable analytics, advertising, and personalization. Third parties may place cookies on the Site for advertising, analytics, and other purposes.
6.1 Retargeting Cookies
We use retargeting cookies to show ads to users who have previously visited our website as they browse the web or use social media. These cookies collect information about your browsing habits so advertising can be relevant to you.
6.2 Behavioral Cookies
Behavioral cookies are used to collect data about your use of our Site. This allows us to understand your preferences and behavior and to provide a more personalized experience.

7. Intended Audience
This website is intended for adults only. This Site is not intended for, and should not be used by, any person under the age of 19 in Nebraska or under the age of 18 in all other regions where we operate. If you are a parent or guardian and believe a minor has provided information through the Site, please contact us.
8. Ownership and Intellectual Property
All content on this Site — including text, graphics, logos, images, video, audio, and software — is the property of ZYP Medical, LLC or its content suppliers and is protected by applicable copyright, patent, trademark, and other proprietary rights. Under no circumstances will you acquire any ownership rights or other interest in any content through your use of this Site. You may view and/or print pages from www.ZYPmed.com for your own personal use subject to the restrictions set in these Terms.
You must not:
Republish material from the Site;
Sell, rent, or sub-license material from the Site;
Reproduce, duplicate, or copy material from the Site;
Redistribute content from ZYP Medical, unless content is specifically made for redistribution.
9. Compliance with Laws
You agree to comply with all applicable laws regarding your use of the Site. You further agree that all information provided by you is truthful and accurate to the best of your knowledge, including information about your identity, location at the time of a telehealth encounter, and medical history.
10. Indemnification
You agree to indemnify, defend, and hold harmless ZYP Medical, LLC and its members, managers, employees, contractors, providers, affiliates, and agents from any liability, loss, claim, and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use of the Site.
11. Disclaimer of Warranties
THE INFORMATION ON THIS SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. ZYP MEDICAL, LLC DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE SITE SHALL BE TO DISCONTINUE USING THE SITE.
12. Limitation of Liability
UNDER NO CIRCUMSTANCES WILL ZYP MEDICAL, LLC BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITE, YOUR SITE USE, OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR CONTENT IS TO CEASE ALL OF YOUR SITE USE.
You may have additional rights under certain laws (including consumer laws) that do not allow the exclusion of implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, the exclusions or limitations in this Agreement that directly conflict with such laws may not apply to you.
13. Copyright and Copyright Agent (DMCA)
If you believe your work has been copied in a way that constitutes copyright infringement, please provide a written notice containing:
An electronic or physical signature of the person authorized to act on behalf of the copyright owner;
A description of the copyrighted work that you claim has been infringed;
A description of where the allegedly infringing material is located on the Site;
Your address, telephone number, and email address;
A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
A statement by you, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

14. Governing Law
You agree that the laws of the State of Nebraska, without regard to its conflict-of-laws provisions, govern these Terms and any dispute that may arise between you and ZYP Medical, LLC or its affiliates, except to the extent the laws of the state in which you reside or received care control for consumer-protection or professional-licensure matters. Venue for any action shall lie in the state or federal courts located in Douglas or Sarpy County, Nebraska, and you consent to personal jurisdiction therein.
15. Severability
If any provision of this Agreement is adjudged by a court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement otherwise remains in full force and effect.
16. Waiver
The failure of ZYP Medical to exercise or enforce any right or provision of this Agreement shall not operate as a waiver. Any waiver must be in writing and signed by an authorized representative of ZYP Medical.
17. Termination
ZYP Medical, LLC may terminate this Agreement or your access to the Site at any time, with or without notice, for any reason.
18. Relationship of the Parties
Nothing in this Agreement or your use of the Site constitutes a partnership, joint venture, employment, or agency relationship between the parties. Neither party has authority to incur, assume, or create any obligation on behalf of the other.
19. Entire Agreement
These Terms of Use, together with our Privacy Policy, Notice of Privacy Practices, and any telehealth informed-consent documents executed by you as a patient, constitute the entire agreement between you and ZYP Medical regarding the Site. ZYP Medical may revise these Terms at any time by updating and posting the revised Agreement on the Site. Your continued use of the Site after any changes signifies acceptance of those changes.
20. Consent
By using our Service, you consent to these Terms and Conditions of Use. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
21. Electronic Agreement
This Agreement is an electronic contract that sets out the legally binding terms of your use of the Service. By registering for the Service, clicking “I Agree” or “Accept” (or a similar button or checkbox), or by using the Service in any manner, you agree to these Terms as they may be updated from time to time. This electronic agreement acknowledges that you are able to electronically receive, download, and print this Agreement.
22. Acknowledgement
By using the Service, you acknowledge that you have read these Terms of Use and agree to be bound by them.
