Welcome to ZYPmed.com. This website is owned and operated by ZYP Medical, LLC ("ZYP," "we," "us," "our"). "You" and "your" mean the person using this website. "Site" means ZYPmed.com and its pages. "Services" means the health care services ZYP provides. By using the Site, you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Site.

1. About These Terms

These Terms govern your use of the Site. If you become a ZYP patient, your care and billing are governed by the ZYP Patient Services, Membership, and Consent Agreement and any treatment-specific consents you sign. If these Terms and that Agreement differ about your care or billing, the Agreement controls.

ZYP may update these Terms by posting a new version on the Site with a new "Last Updated" date. Changes apply to your use of the Site after they are posted. The current version is always at www.ZYPmed.com/terms-of-use.

2. About ZYP Medical

ZYP Medical, LLC is a direct-pay medical practice based in Gretna, Nebraska. We provide men's health and testosterone replacement therapy (TRT), medical weight loss (including GLP-1 medications), virtual urgent care, and related services by secure telehealth and in our clinic. Services are provided by a licensed Family Nurse Practitioner.

ZYP does not bill insurance, Medicare, or Medicaid, and does not provide Services to Medicare beneficiaries. Prices shown on the Site may change. The price in effect when you enroll, as stated in your Patient Agreement and Hint account, controls.

2.1 States Where We Provide Care

You must be physically located in one of these states at the time of every visit and prescription:

  • Weight loss, virtual urgent care, and general services: Nebraska, Iowa, South Dakota, Kansas, Colorado, Arizona, and Minnesota.

  • Testosterone and any other controlled substance: Nebraska, Iowa, and Arizona only.

ZYP cannot provide care to patients located in any other state. This list may change; the current list on the Site controls.

2.2 License to Use the Site

ZYP grants you a limited, revocable, non-exclusive license to use the Site for your personal, informational use and to engage ZYP for Services. You may not copy, republish, sell, sublicense, or create derivative works from the Site; reverse engineer or attempt to compromise the Site; or use the Site in violation of any law.

3. Medical Disclaimer and Scope of Services

Content on the Site is general information. It is not medical advice and does not replace an evaluation by a licensed clinician. Using the Site does not create a provider-patient relationship. That relationship begins only after you complete intake, a ZYP provider evaluates you, and the provider accepts you into care.

If you think you are having a medical emergency, call 911 or go to the nearest emergency room. ZYP does not provide emergency care.

3.1 Services Not Offered

ZYP does not provide:

  • disability, workers' compensation, independent medical, or insurance evaluations;

  • pre-surgical clearance, work accommodation evaluations, or legal or expert testimony;

  • management of pregnancy or pregnancy complications; or

  • controlled substances other than testosterone. ZYP does not prescribe stimulants (for example, Adderall or Vyvanse), opioids, benzodiazepines, or buprenorphine (Suboxone). Testosterone, a Schedule III controlled substance, is prescribed only to patients physically located in Nebraska, Iowa, or Arizona, in accordance with applicable federal and state law.

3.2 Compounded and Off-Label Medications

Some medications ZYP prescribes are compounded. Compounded medications, including compounded semaglutide and compounded tirzepatide, are not FDA-approved and have not been reviewed by the FDA for safety, effectiveness, or quality. They are prepared by a licensed pharmacy for the individual patient based on a prescription. Compounded semaglutide and tirzepatide are not generic versions of, and are not the same as, Ozempic, Wegovy, Mounjaro, or Zepbound.

Some FDA-approved medications are prescribed off-label, meaning for a use, dose, or patient group different from the FDA-approved label. Off-label prescribing is legal and common when clinically appropriate. Risks, benefits, and alternatives are discussed with each patient before treatment.

3.3 No Guarantee of Results

Results vary from person to person and depend on your health, labs, adherence, and your provider's clinical judgment. ZYP does not guarantee any specific weight loss, hormone level, energy, libido, fertility, appearance, or other result. Testimonials and examples on the Site reflect individual experiences and are not typical or guaranteed outcomes. Some images on the Site are illustrations, stock photography, or AI-generated and do not depict actual ZYP patients unless clearly labeled.

4. Privacy and HIPAA

Your use of the Site is governed by our Privacy Policy at www.ZYPmed.com/privacy-policy. Health information you provide as a patient (through the Hint Health patient portal, intake, telehealth visits, or secure messaging) is protected health information governed by HIPAA and our Notice of Privacy Practices at www.ZYPmed.com/notice-of-privacy-practices. Do not include detailed health information in public website forms, such as a general contact form.

5. Cookies and Tracking

The Site uses cookies and similar technologies. Some are strictly necessary for the Site to work. Others may support analytics and advertising on the public, marketing pages of the Site. You can manage cookies using our cookie banner, your browser settings, or the options in "Your Privacy Choices" in our Privacy Policy. We honor Global Privacy Control (GPC) browser signals.

ZYP does not place advertising or analytics tracking technologies on patient portal, appointment booking, intake, or other pages where patients enter health information.

6. Intended Audience

The Site and Services are for adults only: 19 or older in Nebraska and 18 or older in every other state where we operate. If you are a parent or guardian and believe a minor has provided information through the Site, contact us at info@zypmed.com.

7. Ownership and Intellectual Property

All Site content, including text, graphics, logos, images, video, audio, and software, belongs to ZYP Medical, LLC or its licensors and is protected by copyright, trademark, and other laws. You may view and print pages for your personal use only. You may not republish, sell, rent, sublicense, reproduce, or redistribute Site content unless it is specifically offered for sharing.

8. Your Responsibilities

You agree to use the Site lawfully and to provide truthful and accurate information, including your identity, your location at the time of any telehealth visit, and your medical history.

9. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT ALLOWED BY LAW, ZYP DISCLAIMS ALL WARRANTIES ABOUT THE SITE, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ZYP does not warrant that the Site will be uninterrupted or error-free.

10. Limitation of Liability (Website Use Only)

TO THE EXTENT ALLOWED BY LAW, ZYP IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR ITS GENERAL INFORMATIONAL CONTENT. This section applies only to your use of the Site. It does not apply to, and does not limit ZYP's responsibility for, health care Services provided to patients, which are governed by the Patient Services, Membership, and Consent Agreement and applicable law. Some states do not allow certain limitations, so some of these limits may not apply to you.

11. Copyright Notices (DMCA)

If you believe content on the Site infringes your copyright, send a written notice that includes: your physical or electronic signature; a description of the copyrighted work; where the material appears on the Site; your address, phone number, and email; a statement that you believe in good faith the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

12. Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-laws rules, except where the law of the state where you live or received care applies to consumer-protection or professional-licensure matters. Any lawsuit about these Terms will be brought in the state or federal courts located in Douglas or Sarpy County, Nebraska.

13. Access to the Site

ZYP may suspend or end your access to the Site at any time. Ending Site access does not end your care as a patient. Discharge from care is governed by the Patient Services, Membership, and Consent Agreement.

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. ZYP's failure to enforce a provision is not a waiver. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship. These Terms, the Privacy Policy, the Notice of Privacy Practices, and (for patients) the Patient Services, Membership, and Consent Agreement and any signed consents are the entire agreement about the Site. By using the Site, you agree to these Terms electronically and confirm you can download and print them.
